CartBak warrants, subject to the limitations set forth below, that this hard disk cartridge product (the "Product") is free from defects in material and manufacture at the time of purchase.
CartBak warrants that the hard drives will be free from defects in material and workmanship under normal use and service during the applicable four year warranty period. If during the applicable four year warranty period a cartridge is found to be defective in materials or workmanship during normal use and service, CartBak, at its option, will repair or replace the hard drive without charge.
This warranty does not apply to the failure of the Product resulting from misuse, abuse, accident, neglect or mishandling. The warranty is void if the product has been disassembled or tampered with in any way.
The limited warranty commences from the date of manufacture found on the cartridge bottom label.
This limited warranty will beCartBak's sole obligation in the event of any problem of any kind with any cartridge, and the rights herein will constitute the exclusive remedies of any CartBak Customer or any consumer, end user or any other person. CARTBAK EXPRESSLY DISCLAIMS ANY OTHER REPRESENTATION, OBLIGATION, WARRANTY OR CONDITION OF ANY KIND, INCLUDING ANY IMPLIED CONDITIONS OR WARRANTIES ARISING BY OPERATION OF LAW, TO THE FULL EXTENT PERMITTED IN ANY JURISDICTION.
CartBak's liability will in no event exceed the amount paid for the cartridge, and it will not be liable or responsible under any circumstances to any CartBak Customer, consumer, end user or any other person for any additional, direct, indirect, consequential or economic damages of any kind, whether for negligence or otherwise, and whether arising from or relating to hard drive failure and/or the loss of data, or otherwise.
Data stored on hard drive cartridges should be backed up regularly ( you are probably doing this with our product already) .
Return Policy
Please note that you must have RMA authorization from CartBak prior to shipping defective drive(s) for replacement. Call 720-204-1899 for your RMA instructions. All products sent to CartBak for warranty repair must be sent freight prepaid in the packing materials provided by you from CartBak. When we issue you an RMA, we will immediately send you out a replacement cartridge. Simply place the defective product in the envelope provided with the replacement cartridge and send back to us preferrably by a courier service or some means which can authenticate delivery. CartBak is not responsible for cartridges that we don't receive back. If we do not receive the defective cartridge within one month of sending out a replacement, we will bill your credit card for the purchase price of the additional cartridge we sent out. We recommend that you use a carrier with tracking capability in which proof of delivery by way of signature is available.
Product that arrives damaged in shipment due to improper packaging will void the warranty, and will be returned at customer's expense.
